Overview

Marshfield adopted the Wisconsin Unform Dwelling Code.  "The provisions and regulations of the state uniform dwelling code adopted by the Department of Safety and Professional Services as set forth in the Wisconsin Administrative Code, SPS chapters 320—325, inclusive, and SPS chapter 328 are hereby made a part of this chapter by reference."  Marshfield Municipal Code, Ch. 15, Art. II, § 15-52. State uniform dwelling code (accessed 7/10/2014) (page 274).  The Wisconsin code is a statewide code that applies to new construction, additions and alterations for buildings constructed after 1980.  Wis. Adm. Code § SPS 320.04 Applications (accessed 7/9/2014). Marshfield's adoption extends the applicability to repairs, alterations and remodeling occuring prior to 1980.   Marshfield Municipal Code, Ch. 15, Art. Likewise, Marshfield adopted the state commercial building code.  "The provisions and regulations of the building code adopted by the Department of Safety and Professional Services as set forth in theWisconsin Administrative Code at chapters SPS 305, 361 to 365, 367, 370 and 375 to 379, inclusive, are hereby made a part of this chapter by reference . . ."  Marshfield Municipal Code, Ch. 15, Art. Wisconsin adopted the 2009 IBC.  It applies to "code applies to all public buildings and places of employment" with certain exception.  See Wis. Admin. Code § 361.02. The Code defines "public buildings" and "places of employment." Id.

The highest authority is reserved by the state. See Wis. Admin. Code § 361.03. However, local jurisdictions may adopt stricter standard that are not in conflict. Id.  Furthermore, local jurisdiction, including counties, may take on inspection and review responsibilities.  See Wis. Admin. Code § 361.60.

 

Wisconsin adopted the 2009 IEBC, subject to the modifications specified in chapter SPS 366.

Existing Buildings

Existing buildings, meaning buildings that were built in accordance to code at the time of construction, typically merit extra consideration in a current updated code.

The Wisconsin code is a statewide code that applies to new construction, additions and alterations for buildings constructed after 1980.  Wis. Adm. Other provisions of particular interest in the code are as follows:

(3) Minor repairs. If it is the judgment of the building services supervisor, no permit shall be required for any repairs or minor alterations which do not affect or change the occupancy, use, areas, structural strength, fire protection, room arrangement, light or ventilation, access to or efficiency of any exit stairways or exits or exterior aesthetic appearances.

Sec. 15-11. Reshingling of roofs.
It shall not be necessary for any person to obtain a permit for the reshingling of a roof if in the process of reshingling such roof is not changed in size or shape in any manner and if the roof is not to be reshingled with materials of a lesser fire resistance quality. All three of these requirements, size, shape and materials used, must be shown prior to the elimination of the permit which would ordinarily be necessary under this chapter.
